People working in non-government organisations have specific legal responsibilities and liabilities and these may vary between organisations.

A number of ethical and legal duties must be considered, and an organisation's board members should be familiar with relevant areas of law.

Some of an organisation's legal responsibilities may be covered by insurance.

Key legislation

• The Community Services Bill and Regulation is designed to support the work of community organisations and ensure Queenslanders have access to high-quality, safe and accountable community services.
• The Disability Services Act 2006 promotes the rights of people with a disability, increasing their wellbeing and encouraging their participation in the community.
• The Queensland Department of Employment and Industrial Relations website provides links to key legislation with which your organisation must comply.

• Anti-discrimination legislation promotes equality of opportunity for everyone by protecting them from unfair discrimination in various situations, including employment.
• Environmental Protection legislation defines organisations' obligations to ensure 'ecologically sustainable development'.
• Queensland Taxation and the Australian Tax Office provide non-profit organisations with information on GST and other tax matters.
• Legal Aid Queensland's website explains organisational legal liabilities and duty of care.
• The Department of Employment and Industrial Relations website details organisations' occupational health and safety requirements.

Insurance

• WorkCover Queensland is one of the main providers of workers' compensation insurance to Queensland employers.
• Insurance update for not-for-profit community groups is a Queensland Treasury service that provides information on insurance and risk management support.
• Volunteering Queensland provides information about insurance for organisations who use volunteers.
